These Terms of Service (“Terms”) govern your access to and use of the Cup mobile application on iOS and Android (the “App”) and any related services provided by Cup (“Cup”, “we”, “us”, or “our”). By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
01 Acceptance of terms
By downloading, accessing, or using the App, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. These Terms form a legally binding agreement between you and Cup.
02 Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account and use the App. By using the App, you represent that you meet this requirement and that the information you provide is accurate and complete.
03 Your account
- You are responsible for keeping your account credentials confidential and for all activity that occurs under your account.
- Please notify us promptly if you suspect any unauthorised use of your account.
- You agree to provide accurate, current information and to keep it up to date.
- We may suspend or close accounts that contain false information or are used in breach of these Terms.
04 Orders
The App lets you browse and place orders with participating restaurants and partners. When you place an order:
- Prices, availability, and menu items are set by restaurants and may change without notice.
- An order is confirmed once you receive confirmation in the App; until then it may be declined or adjusted.
- You are responsible for providing accurate order and delivery details so restaurants and partners can fulfil your order.
05 Cancellations
You may cancel an order before it is accepted or prepared, where the App allows. Once a restaurant begins preparing your order, cancellation may not be possible. If an order is incorrect, damaged, or not delivered, contact us and we will work with you and the restaurant to make it right.
06 Acceptable use
You agree not to:
- Use the App for any unlawful, fraudulent, or harmful purpose.
- Interfere with, disrupt, or attempt to gain unauthorised access to the App, our systems, or other users’ accounts.
- Copy, modify, reverse-engineer, or create derivative works from the App except as permitted by law.
- Submit false, abusive, or misleading content, reviews, or reports.
- Use automated means to access the App or collect data without our consent.
07 Intellectual property
The App, including its content, design, logos, and software, is owned by Cup or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, and revocable licence to use the App for personal, non-commercial purposes in accordance with these Terms. All other rights are reserved.
08 Third-party services
Orders are fulfilled by independent restaurants and delivery partners, and the App relies on third-party services such as maps and analytics. We are not responsible for the acts, omissions, or content of these third parties, and their services may be governed by their own terms.
09 Disclaimers
The App is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, error-free, or secure, or that food and services provided by restaurants will meet your expectations.
10 Limitation of liability
To the maximum extent permitted by law, Cup shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss of profits, data, or goodwill arising from your use of the App. Nothing in these Terms limits liability that cannot be excluded under applicable law.
11 Termination
You may stop using the App and request account deletion at any time. We may suspend or terminate your access if you breach these Terms or use the App in a way that could cause harm to us, other users, or our partners. Provisions that by their nature should survive termination will continue to apply.
12 Changes to these terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, notify you in the App. Your continued use of the App after changes means you accept the updated Terms.
13 Governing law
These Terms are governed by the laws applicable in the jurisdiction in which Cup operates, without regard to conflict-of-law principles. Any disputes will be subject to the exclusive jurisdiction of the courts of that jurisdiction, unless otherwise required by local law.
